Terms of service
Using Holly.
These terms govern your use of the Holly Labs SMS service and the Lattice property-manager dashboard. They apply to both property managers who sign in to manage their buildings and the tenants who text Holly’s number.
Acceptance of these terms
By using the service — texting Holly’s number, signing in to the property-manager dashboard, or accessing textholly.com — you’re agreeing to these terms. If you don’t agree, don’t use the service.
Who Holly Labs is
Holly Labs LLC operates the Lattice software platform. Holly is the AI persona that tenants text. We’re a small, pre-beta team working with a limited number of property managers; these terms may evolve as the product matures.
Who can use the service
Property managers must be authorized to manage the properties they enter into the platform. Tenants must be 18 or older, in line with the children’s-information section of our privacy policy. Use of the service must be lawful: no harassing, fraudulent, or deceptive messaging.
What the service does
The service has two halves. Holly is an AI assistant that replies to tenant text messages on the property manager’s behalf. The Lattice dashboard lets property managers supervise escalations, review conversation history, and configure their property-specific context.
Holly Labs runs the software and the underlying infrastructure; property managers decide what context Holly uses for their property and which conversations need human attention.
PM and tenant responsibilities
Property managers are responsible for collecting and recording tenant consent before adding anyone to the SMS program (see the SMS program terms for the consent and opt-out flow), for the accuracy of property-level content they configure (knowledge base, scheduled messages), and for the legality of any broadcasts they author.
Tenants can opt out of the SMS program at any time per the SMS program terms. Opting out of texts doesn’t change anything about the underlying tenancy.
Acceptable use
- Don’t send marketing or spam unrelated to a tenancy relationship.
- Don’t impersonate another property manager, tenant, or Holly Labs.
- Don’t attempt to bypass authentication, rate limits, or other access controls.
- Don’t scrape, reverse-engineer, or probe the platform for vulnerabilities outside an agreed-upon security review.
- Don’t use the service to facilitate illegal activity.
Account security
Property-manager accounts use magic-link email authentication. You’re responsible for keeping access to the email address on file secure. If you believe your account has been compromised, contact us at the email below so we can revoke active sessions and investigate.
Service availability
There’s no formal service-level agreement during the pre-beta period. We aim for high availability but may have planned maintenance windows and occasional outages. Critical SMS delivery depends on Twilio and US wireless carriers; we’re not liable for delivery failures originating with those providers.
No warranty
The service is provided “as is.” Holly is an AI assistant and can make mistakes — property managers must supervise escalations, and tenants should not rely on Holly for emergency response. For emergencies, call 911 or your local emergency number.
Limitation of liability
To the maximum extent permitted by law, Holly Labs is not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total aggregate liability is capped at the fees the property manager has paid Holly Labs in the twelve months preceding the claim — or $100 if no fees have been paid, which applies to pre-beta accounts.
Changes to these terms
We update these terms when our practices change. Material changes are communicated through a dashboard notice or email. Continued use of the service after a change takes effect constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of the State of California. Any disputes are resolved in the state or federal courts located in Alameda County, California.
